"But, even if we say that, at night he does his job and come sunrise, he starts his journey back.", "how can you assume that there is a spot along the path that the killer will occupy on both trips at precisely the same time ?"

It might be elementary for Sherlock holmes but can you prove that ?

Sherlock is a genius. What is to prove that is elementary for him?
Precisely the same time? That would be impossible. If he begins climbing the mountain at sunrise one day, and begins desending at sunrise the next day, then there's around 24 hours different. A percise time only occurs once, and never occurs again. But if you mean the same time of day, only the next day, then this would be true. At some hour and minute on way down, he would be evevetabily be in the same location going down as he was going up.

Yes there is a point where the killer will occupy the same spot twice. Suppose you have two people, one starts at the bottom and one starts from the top.
Both of them starts at sunrise and at some point along the path they will meet. Both of them will travel at various speeds but they will still meet somewhere along the path. When these two people meet, they will be in the same place at the same time.
If the person going up the mountain represents the killer's journey up and the person going down represents the killer's return journey. this means that the killer will be at the same spot at the same time on different days.

i think sam has hit it on the head. and for the anon who said that it is on a different day therefore there is no point, i think you have missed the grasp of the question that it is the same time of day!
I agree that the point on the path that the climber reaches at the same time is at the top when he stops his ascent and begins his descent.
I think it has something to do with the fact that the sun rises in the East and sets in the west. Since the path spirals around the mountain, there will be a singular point directly to the south where the sun would not be shining. If he stopped to rest, he would have stopped in the shade which would be at one of the points on the mountain that are facing directly south...
I think the journey may have taken two days in each direction leaving at sunrise on day one and arriving at sunset on day two then decending at sunrise day three and arriving at the bottom at sunset day four.
The place he stopped would be a cave or shelter of some description on night one and night three.
